1 Appellant, Solomon Broadus, Jr., hereinafter referred to as defendant, was charged, tried and convicted in the District Court, Oklahoma County, Case No. CRF-75-463, for the offense of Unlawful Distribution of a Controlled Dangerous Substance, Heroin, in violation of 63 O.S., § 2-401 [63-2-401]. His punishment was fixed at fifteen (15) years imprisonment and a fine in the amount of Fifteen Hundred ($1,500.00) Dollars, and from said judgment and sentence a timely appeal has been perfected to this Court.
